A felony is a crime in California that is more serious than a misdemeanor. It carries a maximum sentence of more than one year in custody. Being a convicted felon results in SERIOUS consequences that are lifelong, including the loss of your firearm rights.
Misdemeanors carry a maximum sentence of jail up to one year. Even misdemeanors can be very serious and have extreme consequences, such as negative child custody consequences, loss of firearm rights (generally up to ten years for some misdemeanor crimes), loss of CCW, and immigration issues just to name a few.
If arrested for a DUI it is recommended that you request a DMV hearing to dispute the suspension of your license. Stone Law Office can represent you in these hearings in addition to the Criminal Court prosecution of your DUI arrest.
You have 10 days to request an Administration Per Se (APS) Hearing to dispute the loss of your license after a DUI arrest or your license will be AUTOMATICALLY SUSPENDED 30 days after your arrest.
A "Wet and Reckless" DUI plea is still considered a DUI. It does, however, have benefits over a standard DUI conviction.
The DMV administration action and the Criminal Courts are two separate government entities and can punish you separately for your DUI arrest.
If somebody, other than yourself, is injured as a result of your DUI you can be charged with a felony.
DUIs are considered "priorable" by the Courts and the DMV and will count against you for 10 years from the date of the arrest.
